Website Redesign Service (8 posts)

  • I have a client who currently wants a site redesign.  They have no “contract” with the current site designer so I’m wondering who owns the pages that are on the hosts site and how I go about taking the site down and using same domain…

This may be more of a “legal” question but I thought I would post it here to see if anyone has any thoughts.

  • @einsley Erica,

You say “the pages that are on the host’s site.” Who hosts the site? Is it the current site designer, hosting the client’s site on behalf of the client?

Or did the client buy the hosting with a hosting service?

The answer to that question could make all the difference in the world. Feel free to contact me at laura@bloggingbistro.com if you want to discuss privately. My company handles this kind of issue fairly regularly.

  • @laurachristianson Hey Laura, thanks for the quick response!  The client got the hosting service and pays monthly, it is not hosted with the original designer.

  • Hi Erica,The only main issues here might be who “owns” the domain name, and how easily the company will let you transfer the domain and loose a customer. If your client owns the domain – if they bought it in their name – then all legality and ownership belongs to them. It may just be an issue of transfer and repossession – which some web companies can be more “possessive” than others and you may have complications. If your client does not own the domain (if the company purchased it under their name), then hopefully the company will be easy to transfer ownership and you can take control. My company deals with this sort of thing very often, so I’d be happy to help where I can!

  • appreciate that.  Being new to this whole thing I’ve been racking my brain on this one!  May need to contact you directly also.  @melissaagnes

  • @melissaagnes @einsley

Melissa just mentioned what would have been my next question.

The third question, assuming your client owns both their domain name and are using an outside hosting service: is the site built (programmed) using any proprietary or trademarked software or content management system?

If it isn’t, and the client owns the domain name and has easy access to the user login info (username and password) to both the domain name and the hosting service, it should be a fairly straightforward matter to either migrate the site or take it down and start over.

  • Not sure about the trademarked software but I can tell you there is no content management system as they are paying a premium for minor changes, etc. My client has the login information for the hosting service.  With the other designer having the same login info I’m guessing the best thing to do is have them request new login and contact their current designer (which i’m sure they don’t want to have to) to avoid any issues or down pages, etc.

I would like to include something about this in my proposal and contract w/ them.

Feeling slightly overwhelmed, am I making a issue out of something that doesn’t need to be?

  • @einsley contact me anytime! I’m happy to help :)Send me an email with the link to the website. I’ll see what I can see. And I’ll let you know (from what I see) if it should be fairly easy. For the most part though, we always include the transfer within our project quote. Usually, the client has no clue as to what they’re doing, so it only makes sense. But our projects are usually pretty big contracts, so maybe it will be worth it to you and maybe it won’t… I’ll help you figure that one out!Email me at m.agnes@socialmediacrisisacademy.com
