Registered Trademark Username Conflict (8 posts)

Topic tags: trademark, username
  • Hi, @kristi-hines, @mike-stelzner  I have a registered trademark name for my new blog that I went through the paper work for several years ago.  It is: Waving or Drowning® .   I just tried to claim it as a username for my Facebook page.  It is not available because someone else claimed it.  I know I have the “legal” right to the name, particularly across the internet, so am wondering how Facebook handles this or how I should proceed?  Any thoughts? Ever encountered this issue before?  Thanks.

  • @pbcsky

I am moving your post over to the Facebook Club and cc’n @andrea-vahl who I think knows the answer

  • Thanks, I think I posted it there earlier today but perhaps I didn’t do it correctly?  I just noticed I’m an “adventurer”. How in the name of good scouting did that happen?

  • Hi @pbcsky – Yes Facebook does have a way to report Trademark infringements.  Here is the help section on it:  http://www.facebook.com/help/intellectual_property  If you click on the Learn more in the Trademark area you can find out how to report it.  I wanted to give you the whole help section on it so you could read about it.  Hope that helps!

Yes, you get points for posting questions and comments in the clubs so congratulations on your rank advancement :)

  • Thanks, Andrea.  I did find that link earlier by searching on google! Search on Facebook is horrible!  Anyway, they suggested to personally contact the individual first so I have done that just now with a photo of the official trademark paper.  We’ll see.  Thanks for your help, though.  Hopefully, this will work out.  Ever heard of that expression, “I wouldn’t want to be a member of a club who would accept me?”

A club that advances me to explorer hasn’t seen my fitbit stats that suggest very few human beings spend as many hours in a day sedentary as I do.  I wish one could expend calories posting questions and comments!

    Thanks, again.

  • @pbcsky I can see the aerobic benefits of posting and commenting, lol. Too bad my scales can’t!

  • @andrea-vahl, I just wanted to get back to you that after getting no answer for 10 days from the FB user I messaged using my trademarked name (FB recommends you try to contact them individually first if it is possible), I filed a trademark complaint on Friday, July 20th, and got an email today that they had removed the name and I was free to use it.  So, use it I did, so onward we go.  Thanks for your help.

  • @pbcsky We are running into the same issues with a company, except they are using our company name on all properties and throwing in the country of origin on the end of the name. If the name was created before the trademark was issued, do they still have the right to the name?
