  • Friends, I have a question for you please, I can’t seem to find detailed guidelines on using images uploaded by fans.

    Essentially, what I’m asking is: Could a company use images that were posted on their page by their fans? I’m trying to figure out if these images could only be used with user approval, or- if a strong terms & conditions would work.

    Can you please be so kind and point me in the right direction?

  • Alexandra, in the litigious society we live in, making sure the fan photos you re-use in marketing and promotion from those submitted on Facebook should be owned by the party submitting the photo. And even if the photos are owned by the Fan submitting them, you’ll likely need a ‘terms and conditions” disclaimer or a waiver signed off by the Facebook fan.

  • Yes it’s a gray line, @alexandrapotora – in general I would say that since they are uploading them to your Fan page, you could use them.  But, as  @danielmckean said, it’s better to get permission.  I would not want my picture being used in a promotional flyer for example without my knowing.  If I was asked, I would probably say sure, but I would be irritated if I saw it somewhere I didn’t know it was going to be used.
