Facebook Sweepstakes – Using a minimum number of ’likes’ (4 posts)

Topic tags: 3rd Party, App, sweepstakes
  • My question is two fold.  After following all the rules with a third party app, collecting entries, etc. can you state that you’re giving something away after you reach a minimum number of fans?  We’d like to give away one of our products (significant value over $1,000) but only after we’ve reached a specific number of fans.  And if so, do you then have to state in your sweepstakes rules that the sweepstakes is open until that number is met rather than a specific end date (e.g., April 15, 2012)?

    Appreciate the feedback!

    Hi Tammy,

This is a very good question and one that really borders on legality because of the “minimum number of fans”.   There’s a good post on socialmediaexaminer.com that you may want to read.  Pay close attention to the portion on consideration – http://www.socialmediaexaminer.com/social-media-promotions-and-the-law-what-you-need-to-know/

    Hope this helps!

  • I think, that is OK regarding facebooks TOS on sweepstakes, competitions etc, because the “spirit of the law” of their TOS, is to make sure that you dont confuse people into thinking its a facebook mechanism and if something goes wrong, they blame facebook.  However, it skims the edge of their other platform policy, which says “you must not incentivize” people to “LIKE” your page.  So, you need to be careful about how you word it.

    Make sure to say:

    - The competition is not affiliated with fb
    - you choose a random person from your own system (not facebook)
    - The draw will be made once the total LIKES is reached but it has nothing to do with their participation (make sure, likeing is not the mechanism to enter, but it can be the requirement to get access to enter (there is a slight difference))

Thats all I can think of right now, which should make it ok.

  • Thank you for the feedback.  I will definitely check out the article.
